Terms of Use
End User License Agreement for WebhookPush.
1. This agreement
These Terms of Use ("EULA") are a binding agreement between you and Alex Fitterling ("we", "us"), the developer of WebhookPush (the "App"). By downloading, installing, or using the App you accept this EULA. This agreement is concluded between you and us only, and not with Apple Inc. We — not Apple — are solely responsible for the App and its content.
2. License
We grant you a personal, non-transferable, non-exclusive license to use the App on any Apple-branded device that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions. You may not copy, redistribute, reverse-engineer, sublicense, or make the App available over a network where it could be used by multiple devices at once, except as those Usage Rules allow.
3. The service
WebhookPush gives you a private webhook URL: any HTTP POST it receives is delivered to your devices as a push notification. Message payloads are your own content, delivered only to your own devices. You are responsible for the data you send through the service and for keeping your webhook URL and secret confidential.
4. Subscriptions and billing
WebhookPush is free to start. Paid plans (Starter, Pro, Enterprise) are auto-renewable subscriptions sold as in-app purchases and billed through your Apple ID. A subscription automatically renews for the same period unless it is cancelled at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the period ends. You can manage or cancel your subscription at any time in your Apple ID settings; cancellation takes effect at the end of the current billing period. Prices are shown in your local currency before you subscribe. Higher plans raise your daily call and webhook limits; limits are enforced automatically.
5. Acceptable use
You may not use the App to send unlawful, infringing, or abusive content, to harass others, to distribute malware, or to attempt to disrupt, overload, or gain unauthorized access to the service or its infrastructure. We may suspend or terminate access that violates this EULA or that threatens the integrity of the service.
6. Maintenance and support
We — not Apple — are solely responsible for providing any maintenance and support for the App. Apple has no obligation to furnish any support services for the App. For support, contact us at info@sp33c.tech.
7. Warranty
The App is provided “as is” and “as available” without warranties of any kind, to the fullest extent permitted by law. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any) for the App; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App. Any other claims, losses, liabilities, damages, costs, or expenses attributable to a failure to conform to a warranty are our responsibility, not Apple's.
8. Product claims
We, not Apple, are responsible for addressing any claims by you or a third party relating to the App or your use of it, including product-liability claims, claims that the App fails to conform to any legal or regulatory requirement, and claims arising under consumer-protection, privacy, or similar legislation.
9. Intellectual property
In the event of any third-party claim that the App or your possession and use of it infringes that third party's intellectual property rights, we, not Apple, are solely responsible for the investigation, defense, settlement, and discharge of any such claim.
10. Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, or consequential damages, or for loss of data, profits, or business, arising out of or related to your use of the App. Nothing in this EULA limits liability that cannot be limited under applicable law.
11. Apple as third-party beneficiary
Apple and Apple's subsidiaries are third-party beneficiaries of this EULA, and upon your acceptance of it Apple has the right (and is deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary.
12. Privacy
Our handling of personal data is described in our Privacy Policy. You must also comply with any applicable third-party terms when using the App.
13. Governing law
This EULA is governed by the laws of the Federal Republic of Germany, excluding its conflict-of-law rules and without prejudice to any mandatory consumer-protection rights you have in your country of residence.
